Attesté's Legacy Vault is an informational tool designed to help you organize and communicate your wishes regarding your art collection. Attesté is not a law firm, estate planning service, or fiduciary, and does not provide legal, tax, or financial advice.
What the Legacy Vault Is
The Legacy Vault allows you to:
- Record heir designations — document which individuals you intend to receive specific artworks or portions of your collection.
- Create emergency access tokens — generate read-only access links that allow designated individuals to view your collection information in an emergency.
- Write living letters — compose personal messages attached to artworks, intended for your heirs or loved ones.
- View estate duty guidance — see general, publicly available information about estate duty rates in your country.
What the Legacy Vault Is NOT
THE LEGACY VAULT DOES NOT CREATE, CONSTITUTE, OR REPLACE ANY LEGAL DOCUMENT. Specifically:
- Heir designations recorded in Attesté are not wills, testaments, codicils, or trusts. They have no legal force or effect in any jurisdiction.
- Emergency access tokens provide read-only access to digital records only. They do not grant legal authority, ownership, or control over physical artworks.
- Living letters are personal correspondence, not legal instruments. They do not create binding obligations or transfer rights.
- Estate duty guidance is general information only and may not be current, complete, or applicable to your specific circumstances.
- SHA-256 integrity hashing on heir designations protects against data tampering within Attesté but does not constitute notarization, legal certification, or authentication recognized by any court or authority.
Professional Advice Required
WE STRONGLY RECOMMEND THAT YOU CONSULT WITH QUALIFIED PROFESSIONALS BEFORE MAKING ANY ESTATE PLANNING DECISIONS. This includes:
- A licensed estate planning attorney in your jurisdiction to prepare legally binding wills, trusts, or other estate instruments.
- A qualified tax advisor for estate duty planning specific to your situation and jurisdiction.
- A professional art appraiser for valuations intended for estate, insurance, or tax purposes.
- An insurance broker for coverage of artworks designated for specific heirs.
Limitation of Liability
To the maximum extent permitted by applicable law, Attesté and Yield SPM (Pty) Ltd shall not be liable for any loss, damage, or adverse consequence arising from:
- Reliance on heir designations recorded in the Legacy Vault as a substitute for legally binding estate instruments.
- Failure of emergency access tokens to function as intended, including but not limited to technical failures, expired tokens, or access disruptions.
- Any discrepancy between the information in the Legacy Vault and the actual disposition of your estate as determined by applicable law.
- Inaccuracy of estate duty calculations or guidance provided within the app.
Your Responsibility
By using the Legacy Vault, you acknowledge and agree that:
- You are solely responsible for ensuring that your estate planning is conducted through proper legal channels in your jurisdiction.
- The information you record in the Legacy Vault is for your personal organizational purposes only.
- You will not rely on Attesté's Legacy Vault as a substitute for professional estate planning services.
- You understand that the legal disposition of your art collection upon your death or incapacity is governed by the laws of your jurisdiction and any valid legal instruments you have executed — not by records in Attesté.
